Practically the only question which these lawyers put to the different talesmen during the selection of the jury was, "Have you any prejudice against the defendant on account of his race?" In due course they succeeded in getting several Hebrews upon the jury who managed in the jury-room to argue the verdict down from murder to manslaughter in the second degree.
Some few had been accepted, to be sure, but they were not representative of the city, and the list of talesmen who had been examined and excused on one pretext or another numbered fully a thousand.
The jury, it is clear, was purposely drawn from the employing class, or their dependents; of a thousand talesmen summoned, only five or six belonged to the working class.
The malignant class nature of the trial was revealed by the questions asked of the talesmen; nearly all declared that they had a prejudice against Socialists, Anarchists and Communists.
These selections were made at certain stated periods; and the jurors thus chosen from the mass never served on the petit jury, nor were they liable even as talesmen to serve on that jury.
